Stockton Mayor Anthony Silva returned to court Wednesday in Amador County on charges of providing alcohol to minors and recording a game of strip poker with teens at a summer camp last year.
He and his attorneys have filed 4 motions to have the case thrown out.
Defense lawyers filed a motion to suppress evidence obtained from Mayor Silva’s cell phone, a motion against the search warrant, another alleging outrageous government misconduct, and a challenge that the recording did not constitute a felony.
Attorney N. Allen Sawyer says the motions could eliminate a possible trial.
“We believe that absolutely could end this case with a thud if the court were to find for the mayor in this case,” says Sawyer.
Sawyer also says the mayor contends the charges are politically motivated.
He adds though that the motions may be not be decided before the November election in which Silva is running for reelection.
